1. Scope of Services
Sweet Trees Hawai‘i is committed to delivering exceptional care for your trees and estate. Our Tree Care Pro subscription plans include the following service levels:Tree Care Pro - Foundations
Essential care for healthy, productive trees. Starting at $99/month for up to 2 trees:
Pruning (Trees up to 13ft).
Mulching.
Fertilizing.
Green Waste Bin Disposal (if applicable).
Annual Tree Care Health Check.

Tree Care Pro - AlohaExpert care for maximum yield. Starting at $119/month for up to 2 trees:

2. Customer Responsibilities
By subscribing to Tree Care Pro services, you agree to:
Provide accurate information about your property and trees to allow us to deliver effective care.
Ensure access to your property for scheduled services.
Report any changes in the condition of your trees or environment that may affect service.
Adhere to the recommendations provided by Sweet Trees Hawai‘i for the continued health of your trees.
3. Subscription Plans
Sweet Trees Hawai‘i is not liable for any property damage caused by tree pruning, including damage to surrounding structures, plants, or landscaping.
Services are tied to the trees specified in your subscription and must be located within the same estate or property.
Subscription plans cover up to 2 trees. Additional trees may incur additional charges.
Subscriptions renew monthly and may be canceled with a 30-day notice after the promotional period has ended..
4. Refund Policy
Promotional Items: No refunds are available for promotional items, such as discounted mango trees. Customers must subscribe to at least 6 months of Tree Care Pro services to qualify.
Final Sales: All services provided are final and non-refundable once rendered.
Cancellations: No refunds for canceled subscriptions during an active billing cycle.
5. Liability LimitationsSweet Trees Hawai‘i takes all reasonable measures to ensure the quality of our services and the health of your trees. However, we are not liable for:
Environmental factors, such as weather conditions, that affect tree health.
Damage or decline caused by neglect, improper care, or external influences beyond our control.
Unforeseen issues with existing pest infestations, diseases, or structural tree damage.
6. Commitment to QualitySweet Trees Hawai‘i is dedicated to providing:

Transparent recommendations to maximize tree health, beauty, and yield.
Access to professional arborists, grafting experts, and estate planners to support your long-term goals.
General Provisions
Independent Contractors: In cases where Sweet Trees Hawai‘i facilitates connections with third-party arborists, you agree that these professionals operate as independent contractors and not as agents or employees of Sweet Trees Hawai‘i.
Governing Law: This Waiver is governed by the laws of the State of Hawai‘i.
Sweet Trees Hawai‘i reserves the right to update or modify these terms and conditions at any time. Changes will be published on our website and take effect immediately.
By subscribing you acknowledge that you have read, understood, and agreed to the terms and conditions. You also confirm that you are at least 18 years old and authorized to enter into this agreement.

At Sweet Trees Hawaii, we take pride in crafting custom grafted trees tailored to your specifications. Please carefully review our policy before placing your order.1. Deposit and Payment Terms
1.1 Non-Refundable Deposit: A 50% non-refundable deposit is required to secure your order and begin the grafting process.
1.2 Additional Grafts: Each additional graft beyond the initial variety is $50, added to your final balance.
1.3 Final Payment: The remaining balance is due upon notification that your custom grafted tree is ready for pickup or shipment.
2. Production Timeline
2.1 Estimated Timeline: The custom grafting process typically takes 4–6 months to ensure your tree's health and quality.
2.2 Growth Monitoring: After grafting, each tree undergoes a natural healing period and must complete two flushes of growth to confirm the success and strength of the grafts.
2.3 Quality Assurance: This timeline allows us to carefully monitor each graft, ensuring you receive a thriving, high-quality tree.
3. Custom Order Details
3.1 Pre-Order Basis: Custom grafted trees are made-to-order and are not part of our in-stock inventory.
3.2 Your Choice of Varieties: Tailor your tree to feature the varieties you love most, ensuring a personalized gardening experience.
3.3 Patience for Perfection: This process is slower than purchasing an in-stock tree but ensures a product that matches your exact vision.
4. Cancellations and Refunds
4.1 Non-Refundable Deposit: The 50% deposit is non-refundable and covers materials, labor, and ongoing care during the grafting process.
4.2 Order Changes: Changes to your order can be made within 14 days of placing the order. Adjustments after this period may incur additional fees.
5. Receiving Your Custom Tree
5.1 Pickup or Shipment Notification: Once your tree is thriving and has completed two flushes of growth, we will notify you of its readiness.
5.2 Shipping and Delivery: Shipping or delivery costs are not included in the price. Any additional charges for these services must be agreed upon and paid before the tree is shipped or delivered.
5.3 Final Steps: At this time, the remaining balance is due, and we will coordinate pickup or shipment arrangements.

Deposits
Non-Refundable Deposits: Deposits are non-refundable under normal circumstances. A deposit secures your plant or tree and reserves it until the scheduled pickup date.
Exceptions to Non-Refundable Deposits:
If we cancel your order due to unforeseen circumstances or are unable to fulfill your order for any reason, we will issue a full refund of your deposit.
Refunds will not be provided for cancellations initiated by the customer.
Plant Transportation and Liability
Plants and trees are living organisms, and transportation may cause shock or stress to them. While we take all possible precautions to ensure their health at the time of transfer, we cannot be held responsible for any damage, decline, or loss that occurs after the plant leaves our care.
Final Sales
All sales are final once the plant or tree has been picked up or delivered. Sweet Trees Hawai‘i does not offer refunds, exchanges, or returns for plants and trees due to their perishable nature and the unique conditions required for their care.
Care Instructions
We provide detailed care instructions for each plant and tree to help you create an environment in which your plant can thrive. By purchasing from Sweet Trees Hawai‘i, you acknowledge that you are responsible for following these instructions and providing the necessary care. By signing this Waiver, you agree to the following terms and conditions, which release Sweet Trees Hawai‘i from liability related to the Services provided.Acknowledgment of Risks and Consultation
Tree Health and Shock:
We will inform, consult, and advise you on the best care options for your tree, including the potential impacts of pruning on a case-by-case basis, to ensure you are fully informed about the optimal care for the tree’s health.
You acknowledge that tree pruning, especially heavy pruning or “over pruning,” can cause stress or shock to the tree, which may lead to reduced fruit production or a complete cessation of fruiting for 1 to 4 years. This is particularly common with mango trees when heavily pruned for size management.
Potential Hazards of Tree Pruning:Tree pruning and trimming involve inherent risks, including but not limited to:
Falling branches or debris
Minor or major injuries
Property damage caused by falling tree limbs or equipment
You understand and accept these risks as part of the Services.
Professional Arborist Recommendation for Large Trees:For trees exceeding 15 feet in height, we will consult with you on the risks and recommend the involvement of a licensed professional arborist for heavy pruning.We can assist in facilitating contact with a preferred arborist, who will provide their own quotes and operate independently of Sweet Trees Hawai‘i.
Waiver of LiabilityTree Health
Sweet Trees Hawai‘i is not responsible for any adverse effects on tree health, including but not limited to shock, reduced fruit production, or tree decline, resulting from the pruning process, provided we have advised you of the potential impacts in advance.
Property Damage
Sweet Trees Hawai‘i is not liable for any property damage caused by tree pruning, including damage to surrounding structures, plants, or landscaping.
Personal Injury
Sweet Trees Hawai‘i is not responsible for any injuries or accidents that occur during or as a result of tree pruning services, except in cases of gross negligence or intentional misconduct by our Tree Care Specialists.
You agree that you are not liable for any harm, injury, or damages sustained by our Tree Care Specialists while performing the Services.
Assumption of RiskBy engaging Sweet Trees Hawai‘i for tree pruning services, you acknowledge that we will provide advice and consultation tailored to your tree’s specific needs and that you voluntarily assume all risks associated with the pruning process, including potential hazards and impacts on tree health.
IndemnificationYou agree to indemnify, defend, and hold harmless Sweet Trees Hawai‘i, its employees, contractors, and agents from any claims, liabilities, damages, or costs (including reasonable attorney fees) arising from or related to the Services.
General Provisions
